NOTICE OF PROPOSED AMENDMENT TO THE BYLAWS OF

THE MUNICPAL GREEN BUILDING TASK FORCE

TO BE ACTED UPON AT THE REGULAR MEETING OF FEBRUARY 8, 2012 at 1:30 P.M.

This notice is issued pursuant to Section 6 – Amendment of Bylaws of the Municipal Green Building Task Force requiring circulation of proposed amendments in writing to all Task Force Members and noticed to the public at least ten (10) days prior to such meeting.  The Municipal Green Building Task Force will discuss and vote on amending the bylaws as follows:

Resource Efficient Municipal Green Building Task Force Bylaws

Section 1:  Creation and Mission

The Resource-Efficient Building Task Force was established by the Resource Efficiency Requirements and Green Building Standards Ordinance, codified in San Francisco Environment Code Chapter 7, for the purpose of overseeing and assisting in making City Buildings resource efficient.   Chapter 7 of the San Francisco Environment Code established the inter-departmental Municipal Green Building Task Force to oversee and assist in enhancing the environmental design, construction and performance of City buildings, and designates twelve City departments to be represented on the Task Force plus a member of the public. The Task Force advises the Department of Environment on matters of green building policy and reviews municipal green building projects in design to ensure that Chapter 7 of the Environment Code is being properly implemented. The Task Force enables communication about green building issues throughout the City and acts as an educational forum to increase Departmental green building knowledge and share project related successes and lessons learned.

Section 2:  Regular Meetings

Regular meetings shall be held on the second Wednesday of each month at 1:30. Meetings shall be held at 30 Van Ness Avenue, Suite 4100, Main Conference Room

Section 3:  Membership and Chair

(a)  The Task Force membership consists of one member of the public appointed by the Mayor and a representative from each of the following City Departments appointed by the Department Director or designee:

(1)     Department of the Environment;

(2)      Bureau of Architecture within the Department of Public Works (DPW);

(3)     San Francisco Public Utilities Commission (SFPUC);

(4)     San Francisco Recreation and Park Department;

 

 

 

 

(5)     Bureau of Construction Management within DPW;

(6)     San Francisco Municipal Railway;

(7)     Department of Building Inspection;

(8)     Port of San Francisco;

(9)     San Francisco International Airport;

(10)  San Francisco Public Library

(1)  The Department of the Environment;

(2)  The Building Design and Construction Division within the Department of Public Works;

(3)  The Infrastructure Design and Construction Division within the Department of Public Works;

(4)  The San Francisco Public Utilities Commission;

(5)  The Recreation and Park Department;

(6)  The San Francisco Municipal Transportation Agency;

(7)  The Department of Building Inspection;

(8)  The Port of San Francisco;

(9)  The San Francisco International Airport;

(10)  The San Francisco Public Library;

(11)  The Department of Public Health; and,

(12)  The Real Estate Division within the General Services Agency.

 

The representative of the Department of the Environment Department of the Environment’s Municipal Green Building Coordinator shall serve as the Chair of the Task Force.  At least one member of the Task Force shall be a LEED Accredited Professional.  At the chair’s discretion, the chair may establish subcommittees or working groups to perform specific tasks or functions as necessary.

 

(b)  The Task Force Chair, at his or her discretion, may establish subcommittees or working groups on an ad-hoc basis to perform tasks or functions as necessary.

Section 4:  Duties and Responsibilities

(a)   The Municipal Green Building Task Force shall advise the Department of the Environment on the development of green building policy for municipal construction projects. 

(b)   The Task Force shall review municipal construction projects during design and construction for compliance with San Francisco Environment Code Chapter 7 which requires LEED Gold certification for municipal construction projects of 5000 square feet and larger. 

(c)    Task Force members shall communicate with and engage key staff in their respective Departments on green building issues as necessary. 

(d)   Task Force members shall communicate to the Task Force on the current status of projects administered within their respective Departments. 

(e)    The Task Force shall provide learning opportunities for members, other City staff and members of the public through project presentations, project tours and other educational offerings. 

(f)      At least one member of the Task Force shall be a LEED Accredited Professional, and all Task Force members are encouraged to obtain this professional credential. 

(g)   Task Force members shall be in regular attendance at Task Force meetings. 

(h)    The Task Force shall make recommendations to the Director of the Department of Environment on applications for waivers from Chapter 7.    

Section 4 Section 5:  Quorum

At all meetings of the Task Force, the presence of a majority of the members shall constitute a quorum. The affirmative vote of a majority of the members shall be required for the approval of any matter. Therefore, based on the membership of eleven, six members constitute a quorum. Likewise, six affirmative votes are required for the approval of any matter. Notwithstanding the above, the Task Force shall seek to establish consensus among its members and shall attempt to gain each member’s approval of an action whenever possible.

Section 56:  Public Participation

Task Force meetings are open to the public and are publicly noticed.  Any member of the public Each person wishing to speak on an item before the Task Force shall be permitted to make one three minute presentation. Time limits shall be applied uniformly to all members of the public wishing to testify.

Section 67:  Amendment of Bylaws

These bylaws shall be reviewed as necessary and may be amended at any regular meeting of the Task Force, provided such proposed amendments are circulated in writing to all Task Force members and noticed to the public at least ten (10) days prior to such meeting.

Section 78:  Compliance with Applicable Laws

The Task Force shall comply with all applicable laws, including but not limited to the Ralph M. Brown Act (Cal. Government Code Section 54950 et seq.) and the San Francisco Sunshine Ordinance (San Francisco Administrative Code Section 67.1 et seq.) in publishing notices, agendas, and minutes and carrying out its operations and functions. Where publication or posting on a website is required, the Task Force shall use the Department of the Environment’s website.
